Elton Garvey Was 59 Years Old When Killed While Riding His Bicycle

Schenectady County, New York (November 16, 2021) –

A man identified as Elton Garvey passed away following a hit and run accident near the area of State and Lafayette Streets in Schenectady. The crash occurred at 2:30 pm on Saturday November 13. The car that struck him was driving east on State Street and left the scene although the police were able to locate the driver. Garvey was taken to Ellis Hospital where he was pronounced dead. The accident remains under investigation with the Schenectady Police Department.

Liability for Bicycle Crash Car Accidents

Pursuant to Vehicle and Traffic Law §1231, “Every person riding a bicycle … upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle…” Thus, Mr. Garvey had as much right to the roadway as a vehicle.

The Vehicle and Traffic Law states, “every driver of a vehicle shall exercise due care to avoid colliding with any bicyclist, pedestrian, or domestic animal upon any roadway and shall give warning by sounding the horn when necessary.” N.Y. Veh. and Traffic Law §1146.

Investigating a Bicycle Crash Car Accident
